    Affiliate Agreement

    Introduction

    The following agreement is specific to your involvement with the affiliate program (“Program”) of 612 Vermont (“Brand”) managed by the Apogee Agency affiliate management team (“we,” “us,” or “our”). Breach of these terms could lead to immediate termination from the Program and transaction voids. Any terms and conditions set forth by Refersion also govern the terms of this agreement. The term of this agreement will begin upon our acceptance of your affiliate application and/or any modifications of this agreement and will end when terminated by you, us, or Refersion. Any party may terminate this agreement at any time, with or without cause. The management team may be contacted at [email protected].

    Advertising

    You do not have permission to spend money on ads specifically promoting the Brand or its products on any platform. This includes, but is not limited to, search engines, social media, pay-per-click, pay-per-view, pay-per-impression, media buys, social media marketplaces (such as Facebook and Instagram), offline print publications, eBay, Craigslist, billboards, radio, TV/cable, YouTube, and traffic exchanges. We actively monitor for violations of these terms on a daily basis. If you are interested in exploring paid advertising opportunities with the Brand, we are open to collaboration.     Trademark

    Trademarked names include 612 Vermont as well as any misspellings, variations, or similar modifications of the Brand’s name, along with any other keywords specified in this agreement. The Affiliate agrees not to register or use any URLs, domains, or social media profiles (including pages, groups, or forums) that the Brand deems to infringe on its name or trademark. This includes all registered and pending trademarks. The Affiliate further agrees not to use, purchase, or enter into agreements with third parties to exploit the Brand’s trademarks or registered domain names, or any marks or domain names that, in the Brand’s reasonable judgment, could be confused with its trademarks or domain names. This includes, but is not limited to, misspelled versions of the Brand’s trademarks or domain names, whether used in metatags or otherwise. No direct linking, no trademark keyword bidding, no trademark plus coupon keyword bidding, no non-trademark keyword bidding. We monitor this account daily for violations.

    Deals and Promotions

    Affiliates are prohibited from using misleading text, images, or links that imply the existence of deals not explicitly authorized through the affiliate channel. The unauthorized use of exclusive coupon codes will result in voided transactions. Additionally, affiliates may not use user-submitted coupon codes from other marketing channels, such as email, and we reserve the right to void any sales resulting from these actions. Expired coupons and deals must be promptly removed or clearly marked as expired. Affiliates may only use logos, banners, and images provided through the Refersion platform. If you wish to use images from the Brand’s website or social media, please contact us for approval beforehand. We require full transparency regarding who promotes our products and where traffic originates. Sub-affiliate transactions without referring URLs are subject to being voided. Coupon, loyalty, and paid search affiliates are strictly prohibited from using sub-affiliate networks to promote the Brand. We reserve the right to void transactions due to order cancellations, duplicate tracking, returns, credit card fraud, disputed charges, or violations of this agreement.

    FTC Compliance

    Affiliates must disclose their relationship with the Brand in all promotional content, including blog posts, videos, emails, social media, and websites. Your audience must be aware that you may earn commissions from clicks or purchases made through your links. This disclosure must be clear, concise, and state that you are compensated for your review or endorsement. If you received any products for free, that must also be disclosed. Compliance with FTC guidelines is required to remain in this Program. We reserve the right to audit your affiliate promotions to ensure proper disclosure. Specific requirements include:

    • Disclosures must appear near the relevant claims and should not require scrolling to find (i.e., above the fold).
    • On image-heavy platforms (Pinterest, Instagram Stories, Snapchat), use #ad on the image or the first in a series. For videos (YouTube), include both verbal and text disclosures in the video and description.
    • Pop-up disclosures are prohibited, and placing disclosures in the sidebar or footer is insufficient.

    On social media, use clear disclosure hashtags like #ad, #advertisement, or #sponsored. Hashtags such as #sp, #spon, #affiliate, or #aff are not acceptable. On Facebook, you may use natural language like: “This post contains an affiliate link, which means I may earn a commission if you make a purchase.” This avoids triggering Facebook’s Handshake Tool or Instagram’s Branded Content Tool, which you should not use to connect with the Brand or Apogee Agency. For more information on FTC compliance, review the FTC Guides on Endorsements and Testimonials, the FTC Endorsements website, and the FTC Dot Com Disclosures. These resources provide guidance but do not guarantee compliance. We recommend seeking legal advice for how these rules apply to your specific promotional activities.

    You are welcome to purchase products or services from the Brand using your own affiliate links. We encourage this, as it allows you to authentically share your experience and speak to the entire customer journey. Additionally, we recommend staying engaged by communicating with us and reading our newsletters for valuable tips, ideas, and best practices.
